FTC Extends Deadline for Facial Recognition Tech Review

The extension allows a comprehensive assessment of ESRB’s age estimation technology proposal.

The Federal Trade Commission (FTC) has extended its commenting deadline by 120 days for considering an application submitted by the Entertainment Software Rating Board (ESRB) in collaboration with Yoti and SuperAwesome.

The application, submitted in June 2023, is seeking approval for the use of “Privacy-Protective Facial Age Estimation” technology under the Children’s Online Privacy Protection Act Rule. This technology analyzes a user’s facial geometry to verify their adulthood.

ESRB, which currently operates a COPPA safe harbor program, had its application subject to public comment in accordance with COPPA regulations. Due to receiving over 350 comments, the FTC has extended the original deadline to ensure a thorough review of the comments and proposal. The Commission’s decision to extend the deadline was unanimous.
